Forebearance vs. Forbearance

The Merriam-Webster's Dictionary of Law lists forebearance as an alternative for forbearance (http://dictionary.reference.com/search?q=forebearance). It is very odd though that the OED doesn't have it - is it an Americanism? David Driscoll
